    What is Power of Attorney

A Power of Attorney (PoA) is an arrangement that allows someone (known as an attorney) to make decisions and act on behalf of another person (known as the donor).

This can be helpful if the donor needs support managing their finances or is unable to make decisions now or in the future.

People often choose to set up a Power of Attorney for peace of mind, particularly if they are:

    • Living with a long-term illness or disability
    • Concerned about future memory loss or dementia
    • Planning ahead, just in case they need help later on.

    Types of Power of Attorney

    • Lasting Power of Attorney (LPA)

      • There are two types of LPA: one for financial affairs, and one for health and care decisions.

      • A property and financial affairs LPA can be used with the donor's permission while they have mental capacity and remains valid if they lose mental capacity.
    • Ordinary Power of Attorney (OPA)

      • Can be used for property, financial affairs or a specified transaction or matter.

      • Cannot be used in relation to the donor's health and personal welfare.

      • Generally comes to an end if either the donor or attorney dies or loses mental capacity.
    • Court Appointed Deputies

      • Can make decisions on behalf of someone who lacks mental capacity.

      • May be appointed by the Court of Protection to make decisions about finances, property, health, or welfare.

      • Only relevant where the court has determined that a deputy is needed.

Registering a Power of Attorney with us

    Step 1

To register authority on an account, we’ll need evidence that the attorney is authorised to act on the donor’s (customer’s) behalf.

    They can provide:

    • A Lasting Power of Attorney (LPA)
    • A Court of Protection Deputyship Order
    • An Ordinary Power of Attorney (OPA)

If the donor has a registered Lasting Power of Attorney (LPA), they can provide an access code from the Government website service so we can verify it online.

If the donor has an Ordinary Power of Attorney (OPA), or does not have an access code for any other reason, they'll need to send us the original document or an official copy by post to Close Brothers Savings, 10 Crown Place, London, EC2A 4FT.

    Step 2

Complete the 'Register a PoA' form below.

    Step 3

Once the form has been completed and submitted, we aim to register a Power of Attorney (PoA) within 5 working days for existing customer accounts.

If the PoA document needs to be posted to us, or if we need additional proof of identity or residency, processing may take longer.

For new customers, we will send an application form to the address provided within 2 working days of receiving the completed PoA form.

    Power of Attorney FAQs

Can I open an account on behalf of someone else online?

No. If you're opening an account on behalf of someone else as an attorney, we'll need to verify your authority first, so applications can't be completed online.

Complete the 'Register Power of Attorney' form above and we'll send you an application form by post, or you can contact our Customer Services team to request one.

How can I contact Customer Services?

As attorney, how do I manage the account?

Once you're registered as attorney with us, you can manage the account by contacting our Customer Services team or writing to us at: Close Brothers Savings, 10 Crown Place, London, EC2A 4FT.

How can I contact Customer Services?

As attorney, how will I know when the account has been opened?

We’ll write to you once the account has been opened and let you know any next steps.

If I’m a jointly appointed attorney, can I apply for a savings account without the other attorneys?

This depends on how the attorneys are appointed in the Power of Attorney document. Some attorneys must act together for all decisions, while others may be able to act independently or have different arrangements for different decisions.

      Where attorneys must act jointly

      • All attorneys must sign the application form
      • You'll need to provide details for all attorneys
      • We'll need to see the Power of Attorney document (or an LPA access code where applicable)
      • Instructions relating to the account must be agreed by all attorneys.

Where attorneys can act independently (jointly and severally)

      • Only one attorney needs to sign the application form
      • We'll only need the details of the attorney acting on the customer's behalf
      • We'll need to see the Power of Attorney document (or an LPA access code where applicable)
      • Any attorney can give instructions relating to the account
      • If the attorneys are appointed jointly and severally, they may act either together or independently.

The attorneys will need to have the required permission to manage the account.
